A proposito di scioperi nella scuola. Se il ministro Brunetta volesse fare qualcosa di serio...

Anche in occasione dell’ultimo sciopero della scuola si è riproposta un’annosa questione, quella della "volontarietà" della comunicazione – da parte del personale della scuola – dell’adesione o meno allo sciopero. Questo fatto, per gli effetti che sovente produce, mette in crisi molti dirigenti scolastici - o meglio molte scuole - ed ha riflessi negativi sull’utenza, alunni e genitori.

Ma vediamo ancora una volta di cosa si tratta. Innanzi tutto sul piano normativo. La legge 146/90 sull’esercizio del diritto di sciopero nei servizi pubblici essenziali sancisce il diritto dell’utenza di essere adeguatamente informata "almeno cinque giorni prima dell’inizio dello sciopero" in ordine "ai modi e ai tempi di erogazione dei servizi" (art.2, comma 6). Le disposizioni di attuazione della legge 146 allegate al CCNL, fondate su un protocollo d’intesa tra amministrazione e organizzazioni sindacali, prevedono la "volontarietà" della dichiarazione di adesione da parte dei docenti e del personale ATA. Sulla base dei dati conoscitivi acquisiti il dirigente scolastico deve valutare l’entità della riduzione del servizio e comunicare alle famiglie le modalità di funzionamento o la sospensione del servizio scolastico.
In parole povere, l’allegato al Contratto della scuola prevede la "dichiarazione volontaria": il personale non è obbligato a comunicare al dirigente scolastico se intende o meno aderire allo sciopero. Può riservarsi anche di non comunicare nulla e decidere all’ultimo momento se scioperare o no. In pratica: si può dire ma si può anche non dire. Il dirigente scolastico ha invece l’obbligo di comunicare all’utenza se il servizio funzionerà o meno, se funzionerà per intero o in forma ridotta, quali classi saranno interessate, se saranno garantiti l’insegnamento e la vigilanza o meno e per quali classi, ecc. Deve cioè garantire i servizi minimi, in caso di sciopero.

Non di rado accade che, sulla base dei "dati conoscitivi" in suo possesso, il capo d’istituto non è in grado di comunicare in "forma adeguata" alle famiglie la modalità di funzionamento o l’eventuale sospensione del servizio scolastico, non essendo egli stesso in grado di prevedere se il personale scolastico che, volontariamente, non ha reso alcuna dichiarazione aderirà allo sciopero o presterà servizio. Sembrerebbe una contraddizione in termini. E infatti lo é. Il problema è particolarmente serio nella scuola di base, materna ed elementare in particolare, ove la vigilanza sugli alunni, la loro custodia riveste una certa importanza e problematicità.

Abbiamo già detto in passato di casi (per fortuna limitati ma comunque paradossali) di istituti scolastici in cui un certo numero di insegnanti non ha voluto dichiarare la propria adesione o meno allo sciopero. Il capo d’istituto ha comunicato alle famiglie (non poteva fare diversamente) che "il servizio non era garantito". I genitori hanno tenuto i figli a casa. I docenti in questione si sono poi presentati regolarmente in servizio. Senza alunni.

Mettiamo, come si dice, i piedi nel piatto. Si tratta veramente di garantire un presunto diritto (la possibilità di dichiarare, non dichiarare, prendere tempo….) oppure di mantenere in vita un inaccettabile privilegio? Perché mai un insegnante dovrebbe costringere il dirigente scolastico, col suo silenzio garantito, a mettere inutilmente in allarme i genitori, che si dovranno organizzare per sopperire all’assenza ipotetica delle lezioni, e poi, invece, presentarsi tranquillamente a scuola solo per percepire uno stipendio mal guadagnato?

Ci preoccupa soprattutto il comportamento dei sindacati confederali che, a differenza dei sindacati corporativi o autonomi, dovrebbero avere come stella polare le prerogative del servizio-scuola pubblica e la difesa di tutti i diritti (quello di sciopero ma non solo…).
Forse non ha tutti i torti chi sostiene che non si lede affatto il diritto di sciopero (costituzionalmente garantito) richiedendo di dire con chiarezza se si intende aderire o meno. Aderendo allo sciopero si esprime una forma di protesta e si crea qualche disagio, come è inevitabile in caso di sciopero. Ma non si capisce perché si debba creare disagio senza aderire allo sciopero. Ci sarà pure un diritto dell’alunno all’istruzione (anch’esso costituzionalmente garantito) di cui tener conto… E ci saranno, soprattutto nella scuola di base, dei minori da sorvegliare e vigilare… O no? Contraddizioni del sindacalese. Occorre allora porsi il problema, per noi decisivo, di come contemperare il diritto del lavoratore allo sciopero con il diritto dell’alunno allo studio e con la tutela dei minori.

Il ministro Brunetta, se vuole rendere più efficiente e garantire un funzionamento corretto della pubblica amministrazione, potrebbe farci un pensierino. Invece di parlare, spesso a vuoto e genericamente di "fannulloni", o di introdurre misure dal sapore restrittivo e inutilmente punitivo, potrebbe cominciare da un piccolo e concreto provvedimento come questo. Rendere obbligatoria la dichiarazione di adesione o meno allo sciopero. Con beneficio di tutti, a cominciare dagli alunni ai quali il servizio – se il proprio docente non sciopera – deve essere garantito.

Caro Gandola, di fronte alla incapacità di capire l'assurdità della norma, credo si debba passare a ... vie di fatto. Ho scritto sull'argomento 4/5 interventi (penso anche su Scuolaoggi) dal 2003 almeno, ne ho parlato con Panini e altri del "mio" sindacato. NIENTE. Ho un "archivio" di prese di posizione anche di associazioni provinciali Presidi (Parma). Oggi ho anche scritto a Brunetta sul suo sito. Mah! L'ANDIS ha preso posizione su mia sollecitazione. Credo che ci vorrebbe o una interrogazione parlamentare (a chi ci si rivolge? Al PDL?) o una raccolta di firme da spedire al Ministero. SCUOLAOGGI potrebbe lanciarla? Credo aderirebbe il 90% dei DS: Prova!
