Il DPCM su merito e carriera degli insegnanti

In un recente seminario sul decreto Brunetta (dlg.150) , tenuto a Milano il 17.12.09 dalla CGIL Funzione Pubblica e dalla FLC-CGIL, ci si interrogava sul DPCM di prossima emanazione che dovrebbe definire limiti e modalità di applicazione dei titoli II e III del decreto su merito, premialità e carriere dei docenti , così come è previsto dall'art.74 .
Il DPCM, allo stato attuale è in corso di elaborazione e non potrà che vedere la luce, a nostro avviso, soltanto dopo l'approvazione delle nuove norme sullo stato giuridico degli insegnanti, contenute nella proposta di legge dell'on. Aprea (pdl.n.953).

Ad una conclusione del genere ci si arriva per una serie di considerazioni , salvo incidenti di percorso di questo governo e di questa maggioranza, che cercherò di sintetizzare qui di seguito :
a) lo stato avanzato dei lavori in Commissione Cultura della Camera della pdl.n. 953, presentato nel maggio del 2008 dalla stessa Presidente della Commissione on. Aprea, con l'obiettivo, condiviso da tutta la maggioranza, di licenziarla in questa legislatura.
b) la pdl.953 tra le tante materie che cerca di affrontare con una certa organicità,comprende anche l'adeguamento delle norme sullo stato giuridico degli insegnanti,fermo ancora ai decreti delegati del 1974.
c) in piena sintonia col decreto Brunetta, la filosofia di fondo della pdl.953 è quella del controllo politico di tutta la P.A., la decontrattualizzazione quindi anche della scuola e degli insegnanti
d) il miglioramento dell'efficienza delle istituzioni scolastiche e la loro valutazione con organismi misti interni ed esterni fanno il paio con la valutazione e la carriera degli insegnanti, sempre meno impiegati e sempre più professionisti della formazione
e) carriera articolata su tre livelli , docente iniziale, docente ordinario e docente esperto e un possibile quarto sbocco individuato nella nuova figura del vice-dirigente
f) all'interno di ogni livello progressione automatica per anzianità e scatti biennali da quantificare col CCNL..
Passaggi dal livello iniziale a quello ordinario a domanda e per titoli, valutati da un apposita commissione mentre per diventare esperto sbarramento per titoli ed esami .
Passaggi di livello per contingenti ridotti e definiti annualmente da MIUR
g) il CCNL agirà solo su materie limitate quali orario, retribuzione e mobilità .

Dire che le finalità di fondo del decreto Brunetta possano trovare, per quanto riguarda la scuola e gli insegnanti, parecchi punti di contatto nella pdl 953 dell'Aprea è come scoprire l'acqua calda.
Laddove la pdl. dell'Aprea toglie parecchie castagne dal fuoco al decreto Brunetta, risolvendo quasi interamente le difficoltà legate all'autonomia delle scuole e alla specificità della funzione docente, è proprio sulla carriera degli insegnanti articolata su tre livelli, proprio come vorrebbe fare e fa il decreto Brunetta in materia di premialità e merito.
Altri punti di contatto sono la valutazione delle scuole e dei singoli insegnanti che intercettano le esigenze legate alla performance e al merito, contenuti nel decreto Brunetta.
Il DPCM che sarà varato di concerto col Miur e col Tesoro, potrà trovare forti resistenze da parte di quest'ultimo proprio sui costi che un'operazione del genere potrà comportare.
Ad esempio la presenza di due esterni da retribuire in ogni nucleo di valutazione di scuola, contenuta nella pdl.953 in oltre 10.000 istituzioni scolastiche dovrà trovare la quadra dei conti in forme di autofinanziamento all'interno del comparto, oppure difficilmente avrà il via libera del Tesoro. Del resto è stata proprio la sostenibilità dei costi, ad escludere la scuola dagli organismi di valutazione della performance voluti da Brunetta.

Comunque il DPCM che verrà dovrà necessariamente fare sintesi e adattamento di quanto andrà maturando in parlamento sulle nuove norme dello stato giuridico degli insegnanti.
Ecco perché non potrà vedere la luce prima, fermo restando che le finalità di fondo del dlgs.150/09 si integrano quasi alla perfezione con la pdl.n.953/08:
decontrattualizzazione, forte riduzione del potere sindacale e attribuzione selettiva per legge degli incentivi economici di carriera, in modo da premiare i capaci e meritevoli.
In conclusione, quello che in quindici anni non si è riuscito realizzare per via contrattuale avverrà per legge, calato dall'alto, cioè nel peggiore dei modi possibili per quasi 800mila insegnanti..
Nel 2004 Aran e OO.SS. ci provarono ancora una volta, dopo il contestato art.29, a trovare un accordo per via contrattuale sulla carriera dei docenti. Non si trovarono le risorse e tutto fini lì, non più ripreso né coi governi di centro sinistra né di centro destra.
Ma in politica gli errori come i ritardi si pagano e il vuoto non può resistere a lungo, perché prima o poi arriva qualcuno che lo riempie.
