Negli scorsi giorni abbiamo letto sui giornali che la scuola primaria milanese il prossimo anno dovrà funzionare con 706 insegnati in meno rispetto al numero necessario. Le cattive notizie non sono però finite. Ieri Pippo Frisone in un articolo pubblicato su scuolaoggi.org ha denunciato la mancata attivazione di 148 classi a tempo pieno, che sono state trasformate d'ufficio in classi a tempo normale. In altri termini a 3.500 bambini del milanese è stata negata la possibilità di frequentare il prossimo anno la scuola a tempo pieno.
Tagli
Dal punto di vista del taglio il quadro si appesantisce ulteriormente. Attivare 148 classi a tempo normale al posto di 148 classi a tempo pieno produce un risparmio di circa 114 posti. Il taglio complessivo è quindi di 820 posti. Ma non è solo una questione di tagli.
Chi vincerà la lotteria del tempo pieno?
L'art. 10 comma 3 del DPR n.81/09 prevede che: "Nelle scuole nelle quali si svolgono anche attività di tempo pieno, il numero complessivo delle classi è determinato sulla base del totale degli alunni iscritti. Successivamente si procede alla definizione del numero delle classi a tempo pieno sulla base delle richieste delle famiglie. Qualora il numero delle domande di tempo pieno ecceda la ricettività di posti/alunno delle classi da formare, spetta ai consigli di istituto l’indicazione dei criteri di ammissione."
Non è però una novità della Gelmini perché in sostanza è quanto già previsto dall'art. 15 comma 2 del DM n. 331/98: "Nelle scuole nelle quali si svolgano. anche attività di tempo pieno il numero delle classi parallele da costituire è determinato sulla base dei numero complessivo di alunni, rimettendo ai consigli di circolo l'indicazione dei criteri generali di, ammissione, nel caso di eccesso di domande rispetto alle classi da formare, tenuto conto delle limitazioni derivanti dalla consistenza dell'organico provinciale dei personale docente.".
Quindi spetta ai consigli di istituto stabilire chi sarà "ammesso" al tempo pieno e chi no. Non so se sia mai stata utilizzata questa norma, ricordo solo che nel 2007 si era verificato, sempre nel milanese, lo stesso problema per 550 bambini, ma alla fine le 28 classi a tempo pieno mancanti furono attivate.
Il tempo pieno è un diritto o un servizio a domanda?
La scuola materna non è scuola dell'obbligo e per questo è un servizio a domanda. A Milano all'atto dell'iscrizione viene stilata una graduatoria per ogni scuola secondo criteri fissati dal Comune. Se il numero di posti disponibili è inferiore al numero di domande gli ultimi in graduatoria restano fuori. Chi resta fuori va a finire in una scuola fuori zona oppure in una scuola privata.
Per quanto riguarda il tempo pieno potrebbe accadere qualcosa di simile. La norma demanda ai consigli di istituto la determinazioni dei criteri per stilare una graduatoria. Gli ultimi in graduatoria non saranno "ammessi" al tempo pieno e finiranno in una classe a tempo normale oppure in una scuola privata che offre il tempo pieno, o presunto tale, a pagamento. Ma il tempo pieno è un diritto o un servizio a domanda? Per il momento un servizio a domanda, altrimenti non si spiegherebbe la mancata attivazione di 148 classi.
Limite per l'attivazione di classi a tempo pieno
L'attivazione delle classi a tempo pieno è sempre stata legata al cosiddetto "doppio organico": per ogni classe ci vogliono 2 insegnanti. Infatti per l'attivazione delle classi a tempo pieno è sempre stato posto come limite l'organico e non il numero di richieste. L'art. 130 del Testo Unico (Decreto legislativo n. 297/94) poneva come limite l'organico relativo all'a.s. 1988/89. La Moratti con il Decreto legislativo n. 59/04 ha abrogato l'art. 130 del Testo Unico e così il tempo pieno, e ha posto come limite per lo "spezzatino 27+3+10" l'organico relativo all'a.s. 2003/04 specificando che eventuali incrementi sarebbero stati decisi anno per anno di comune accordo tra MIUR e MEF attraverso il decreto interministeriale sugli organici previsto dalla finanziaria 2002.
Fioroni con la Legge n. 176/07 ha ripristinato l'art. 130 del Testo Unico abrogato dalla Moratti, ripristinando in questo modo il tempo pieno, e ha rimosso il limite fissato dall'organico relativo all'a.s. 1988/89, ma ha imposto come limite quello fissato anno per anno dal decreto interministeriale sugli organici previsto dalla finanziaria 2002. La Gelmini con il DPR n. 89/09 ha abrogato di fatto il tempo pieno sostituendolo con le 40 ore senza compresenze, e con il DPR n. 81/09 ha fissato come limite l'organico relativo all'a.s. 2008/09 subordinando eventuali incrementi sempre al decreto interministeriale sugli organici MIUR - MEF, nel rispetto comunque dei tagli previsti dalla legge n. 133/08.

L'attacco al tempo pieno sferrato dalla Gelmini quest'anno è molto più pericoloso dei precedenti perché non viene attaccato solo il contenuto (compresenze), ma anche il contenitore (40 ore). Se a fronte delle richieste dei genitori la risposta è la mancata attivazione di tutte le classi necessarie, allora il problema assume una portata diversa. Non ci troviamo più solo davanti al caso, altrettanto problematico, ti autorizzo 4 classi a tempo pieno e ti assegno 7 insegnanti, uno spezzone di 6 ore e scordati le compresenze. Adesso può capitare che a fronte di una richiesta di 4 classi a tempo pieno te ne vengano autorizzate 3 a tempo pieno e 1 a tempo normale, e ti vengano assegnati 6 insegnanti e uno spezzone di 15 ore. Oltre alle compresenze bisogna scordarsi anche le 40 ore.
Non dovrà esserci nessuna lotteria del tempo pieno
I consigli di istituto dovranno rifiutarsi di stilare qualsiasi graduatoria. Dobbiamo batterci sia per l'attivazione delle 148 classi mancanti che per il ritiro dei 706 tagli previsti.
Negare il tempo pieno è incostituzionale?
La Corte Costituzionale, a seguito di un ricorso, ha ritenuto incostituzionali gli articoli della finanziaria 2008 che fissavano a circa 94.000 unità il limite massimo per l'organico di sostegno escludendo qualsiasi tipo di deroga. Non può essere allora altrettanto incostituzionale fissare un limite all'organico per il tempo pieno? Penso di sì. Se vogliamo salvaguardare il tempo pieno dobbiamo batterci affinché non sia più considerato un servizio a domanda, ma un diritto.
