Premesso che: l’art.1, comma 601 della legge n. 296 del 2006, Finanziaria 2007, a decorrere dall’anno 2007, ha istituito nello stato di previsione del Ministero della Pubblica istruzione due fondi: uno per le competenze dovute al personale delle istituzioni scolastiche, con esclusione delle spese per stipendi del personale a tempo indeterminato e determinato, l’altro per il funzionamento delle istituzioni scolastiche;
il primo di questi fondi è stato fortemente penalizzato dai tagli operati sulle previsioni 2009 dal decreto-legge 25 giugno 2008, n. 112, convertito, con modificazioni, dalla legge 6 agosto 2008, n. 133, e dalla successiva legge finanziaria per il 2009 (legge 22 dicembre 2008, n. 203);
il D.P.R. del 20 marzo 2009 n.89 ha di fatto ridotto l'opzione relativa al tempo scuola a quella tra tempo normale (TN pari a 24 ore settimanali) e tempo pieno (TP pari a 40 ore settimanali), eliminando così tutte le soluzioni intermedie (27 e 30 ore) e inducendo i nuclei familiari dove entrambi igenitori lavorano a optare direttamente per il TP;
